Abba Kyari Faces Additional Legal Battles Despite Release

Judge rules that prosecutors failed to provide credible evidence linking the former police intelligence boss to alleged asset concealment

A Federal High Court in Abuja has discharged and acquitted former head of the Intelligence Response Team, Abba Kyari, after ruling that prosecutors failed to prove allegations brought against him.

Delivering judgment on Thursday, Justice James Omotosho held that the case filed by the National Drug Law Enforcement Agency (NDLEA) did not contain sufficient and credible evidence to sustain the charges against Kyari and his two brothers. 

The anti-narcotics agency had filed a 23-count charge accusing Kyari of failing to properly declare assets and allegedly disguising ownership of several properties and financial assets. The prosecution claimed that a number of properties in Abuja and Maiduguri were secretly linked to the suspended Deputy Commissioner of Police. 

However, in his ruling, Justice Omotosho said the prosecution could not provide convincing documents proving that the properties in question actually belonged to Kyari. The court also noted that the evidence presented did not sufficiently establish that the former police officer deliberately concealed assets or made false declarations. 

Because of the weak evidence, the court ruled that the charges could not stand under the law and therefore discharged and acquitted Kyari and the other defendants in the case.

Kyari, once regarded as one of Nigeria’s most prominent crime-fighting officers, had been facing multiple legal battles since 2022 after he was arrested and suspended from the police following allegations of links to drug trafficking and other offences.

While the court’s ruling clears him of the asset declaration case, other legal matters involving the suspended police officer have been handled separately by the courts.

The judgment marks a significant development in one of Nigeria’s most closely watched law enforcement cases in recent years.
